Applies to: VR-Track mobile application (iOS & Android) and the MLA File Tracking System web portal.

1. Acceptance of Terms

These Terms and Conditions ("Terms") form a binding agreement between you and the office of Shree Vishwajit Rane, MLA — Valpoi Constituency ("we", "our", or "us") and govern your access to and use of the VR-Track mobile application and the MLA File Tracking System web portal (collectively, the "Service"). By downloading, installing, accessing, or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility and Authorised Use

The Service is intended exclusively for authorised users associated with the office of the MLA and the Valpoi Constituency, including administrators, MLAs, personal assistants, in-charge officers, panchayat members, and departmental representatives. Access is granted on a role-based basis and only to credentialed users issued by the system administrator. You must be at least 18 years of age to use the Service.

3. User Accounts and Credentials

  • You are responsible for safeguarding your login credentials and for all activities that occur under your account.
  • You must not share your credentials, allow others to access your account, or use another user's account.
  • Only one active session is permitted per user on the web portal; a new login automatically invalidates prior sessions.
  • You must notify us immediately of any unauthorised use or suspected compromise of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or unauthorised purpose.
  • Enter false information, impersonate another person, or misrepresent your role or affiliation.
  • Upload, store, or transmit content that is defamatory, obscene, hateful, infringing, or otherwise unlawful.
  • Attempt to bypass authentication, rate limits, encryption, or any other security mechanism.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
  • Use automated scripts, scrapers, or bots to access the Service without prior written consent.
  • Interfere with or disrupt the integrity, performance, security, or availability of the Service.
  • Use the Service to harass, abuse, or harm any person.

5. User-Generated Content

You are solely responsible for any files, grievances, remarks, attachments, or other content you submit ("Your Content"). You confirm that Your Content is accurate, lawful, and respectful, and that you have all necessary rights to submit it. We may review, edit, or remove Your Content where it violates these Terms or applicable law. We do not tolerate objectionable content or abusive behaviour; reports may be sent to the Office and will be acted upon within 24 hours, including removal of content and suspension of the offending user where appropriate.

6. Licence Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Service on devices you own or control, solely for its intended government purpose. All rights not expressly granted are reserved.

7. Intellectual Property

All content, code, designs, trademarks, logos, and branding within the Service are the property of the respective owners and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using the Service you consent to the practices described in the Privacy Policy.

9. Service Availability and Modifications

We endeavour to keep the Service available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, for maintenance, upgrades, security, or operational reasons.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the Service will be error-free or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we, our officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, revenue, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Service, whether based on contract, tort, negligence, strict liability, or any other legal theory.

12. Indemnification

You agree to indemnify, defend, and hold harmless the office of Shree Vishwajit Rane and its personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) Your Content, or (c) your violation of these Terms or any applicable law.

13. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for any breach of these Terms, suspected misuse, or where required by law or administrative policy. Accounts are provisioned and managed by the system administrator; users cannot self-delete their accounts and must contact the administrator for any deactivation or removal request, as further described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including IP, disclaimer of warranties, limitation of liability, indemnification, and governing law) shall survive.

14. App Store — Apple Specific Terms

The following additional terms apply if you obtained VR-Track from the Apple App Store:

  • These Terms are concluded between you and us only, and not with Apple Inc. ("Apple"). Apple is not responsible for VR-Track or its content.
  • The licence granted to you for VR-Track is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms.
  • Apple has no obligation to furnish any maintenance and support services with respect to VR-Track.
  • In the event of any failure of VR-Track to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to VR-Track.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to VR-Track or your use of it, including product liability claims, claims that VR-Track fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party intellectual property infringement claim relating to VR-Track.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Google Play — Android Specific Terms

If you obtained VR-Track from Google Play, you acknowledge that your use is also subject to the Google Play Terms of Service. Google Inc. is not a party to these Terms and is not responsible for the App or its content. Accounts on the Service are provisioned and managed by the system administrator and cannot be self-deleted by users; see the "Account Provisioning & Deletion" section of our Privacy Policy for the administrator-driven process.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Panaji, Goa.

17. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date, and material changes will be notified through the App. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

18. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
